TERMS OF SERVICE

1. Introduction

Welcome to FastlyGo (“we”, “us”, or “our”), a digital platform that connects users (“you”, “your”, “Customer”) with independent restaurants, grocery stores, and delivery partners for the purpose of ordering and receiving food and beverages (“Services”).

By accessing or using our mobile application, website, or any related service (collectively, the “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, you must not access or use the Platform.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement under the laws of the Turks and Caicos Islands to use the Platform.

3. Platform Role

• FastlyGo acts solely as a technology intermediary, and is not a restaurant, retailer, or delivery company.
• Restaurants and stores are independent third parties who operate their own businesses.
• Delivery services are provided by independent contractors (“Delivery Partners”), who are not employees or agents of FastlyGo.
• We do not guarantee the quality, safety, or legality of products sold by restaurants, nor do we assume responsibility for delivery delays or service failures caused by third parties.

4. Account Registration

To use the Platform, you must create an account by providing accurate, current, and complete information.
You are responsible for:

• Maintaining the confidentiality of your login credentials, and
• All activity performed through your account.

5. Ordering and Payments

Orders placed through the Platform are binding once confirmed by the restaurant.

Prices and menu items are determined by the restaurant and may vary.

Payment is processed through a secure third-party payment gateway.

All prices include applicable taxes and delivery fees (if applicable) displayed at checkout.

We may charge service fees to facilitate order and payment processing.

Cancellations and Refunds:

• Orders can only be cancelled before the restaurant begins preparing the food.
• Refunds are issued at our discretion or that of the restaurant, depending on circumstances such as incorrect or missing items.
• Delivery fees are generally non-refundable once a delivery partner has been dispatched.

6. Delivery

Delivery times are estimates and are not guaranteed.

Once the delivery partner confirms delivery to the specified address, responsibility for the order transfers to you.

You must ensure someone is available to receive the order; otherwise, additional charges may apply.

7. User Conduct

You agree not to:

• Use the Platform for unlawful purposes;
• Provide false information about your identity or payment details;
• Interfere with, hack, or alter the security of the Platform;
• Harass or abuse delivery partners, restaurant staff, or customer support staff.

8. Ratings and Reviews

Users may leave feedback about restaurants and delivery partners.

By posting reviews, you grant FastlyGo a non-exclusive, royalty-free, worldwide, and perpetual license to use, reproduce, and display such comments on the Platform or in marketing materials.

We reserve the right to remove abusive, defamatory, or irrelevant reviews.

9. Intellectual Property

All content, trademarks, software, and logos on the Platform are the property of FastlyGo or its licensors.

You may not copy, modify, or distribute any part of the Platform without prior written consent.

10. Limitation of Liability

To the maximum extent permitted by law:

• FastlyGo shall not be liable for indirect, incidental, or consequential damages;
• Our total liability for any claim related to the Platform shall not exceed the total amount paid by you for the order giving rise to the claim;
• We do not guarantee that the service will be uninterrupted or error-free.

11. Indemnification

You agree to indemnify and hold FastlyGo, its directors, employees, and affiliates harmless from any claim, damage, or expense arising from:

• Your use of the Platform;
• Your breach of these Terms; or
• Any action that infringes third-party rights.

12. Privacy and Data Protection

Your privacy is important to us.

Our Privacy Policy, incorporated by reference, explains how we collect, use, and protect your personal information in accordance with the Data Protection Ordinance of the Turks and Caicos Islands.

13. Consumer Protection (Optional Clause)

As a consumer under the laws of the Turks and Caicos Islands, you are entitled to certain legal protections in relation to digital transactions and services.

Nothing in these Terms is intended to exclude or limit statutory consumer rights that cannot be waived by law.

If you believe a restaurant or delivery partner has acted unfairly or provided poor service, you may contact FastlyGo Support at support@fastlygotci.com, and we will help facilitate a fair resolution.

14. Dispute Resolution and Mediation (Optional Clause)

Before initiating any formal legal proceedings, both parties agree to attempt to resolve disputes in good faith through informal negotiation or mediation.

If no resolution is reached within 30 days, either party may refer the matter to the Turks and Caicos Mediation Centre or proceed with court action.

Mediation costs shall be shared equally, unless otherwise agreed in writing.

15. Termination

We may suspend or terminate your access at any time, without notice, if we believe you have violated these Terms or engaged in fraudulent or abusive conduct.

You may also terminate your account at any time by contacting support@fastlygotci.com.

16. Governing Law and Jurisdiction

These Terms are governed by and construed under the laws of the Turks and Caicos Islands.

Any dispute shall be submitted to the exclusive jurisdiction of the courts of the Turks and Caicos Islands.

17. Amendments

We may update these Terms from time to time.

Updates will be effective immediately upon posting on the Platform.

Continued use of the Platform after such posting constitutes acceptance of the new Terms.
